By accessing and using NISU SACCO ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Platform.
2. Description of Service
NISU SACCO provides a cloud-based Software as a Service (SaaS) platform for managing Savings and Credit Cooperative Organizations (SACCOs). Our services include member management, financial accounting, loan processing, and related financial operations.
3. User Registration
To use our services, you must:
- Be at least 18 years of age or the legal age in your jurisdiction
- Have the authority to represent your SACCO organization
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Be responsible for all activities under your account
4. Subscription and Payment
4.1 Free Trial
We offer a 14-day free trial period. No credit card is required for the trial. At the end of the trial, you must subscribe to continue using the service.
4.2 Subscription Plans
Subscription fees are charged monthly or annually based on your selected plan. All fees are non-refundable except as required by law.
4.3 Payment Terms
Payment is due at the beginning of each billing period. Failure to pay may result in service suspension or termination.
5. Data Ownership and Security
You retain all rights to your data. We commit to:
- Store your data securely using industry-standard encryption
- Never sell your data to third parties
- Provide data backup and recovery services
- Allow you to export your data at any time
- Delete your data upon account termination (subject to legal requirements)
6. Acceptable Use Policy
You agree not to:
- Use the Platform for any illegal activities
- Attempt to gain unauthorized access to any part of the Platform
- Interfere with or disrupt the Platform's operation
- Upload viruses, malware, or malicious code
- Impersonate another person or entity
- Violate any applicable laws or regulations
- Use the Platform to process fraudulent transactions
7. Service Availability
We strive to provide 99.9% uptime but cannot guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Platform with reasonable notice.
8. Limitation of Liability
NISU SACCO and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Platform, even if we have been advised of the possibility of such damages.
9. Indemnification
You agree to indemnify and hold NISU SACCO harmless from any claims, losses, damages, liabilities, and expenses arising from your use of the Platform or violation of these Terms.
10. Termination
You may terminate your account at any time through your account settings or by contacting support. We may terminate or suspend your account if you violate these Terms.
Upon termination, your right to use the Platform will immediately cease. You will have 30 days to export your data before it is permanently deleted.
11. Intellectual Property
The Platform and its original content, features, and functionality are owned by NISU SACCO and are protected by international copyright, trademark, and other intellectual property laws.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Continued use of the Platform after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NISU SACCO operates, without regard to its conflict of law provisions.
